真正商品の適法な並行輸入には条件として、アメリカ国内で商標を付与した米国コンバース社と日本国内の商標権者(伊藤忠)が同一人もしくは法的経済的に同一人とみなされないといけないってのがあるが、 両企業とも他人みたいなものなのでこの条件は満たされない

愛知の業者の言い分としてはコンバースといったら昔から米国コンバース商標だからその同一性は必要ねーだろと

裁判所はいやいや今回も内外権利者の実質的同一性は適用しますってことで、

米国コンバース社の許諾があっても、日本の商標権者である伊藤忠の認可がなければ真正の並行輸入とは認められないって結論
