NEWPORT BEACH, Calif. - Nov. 25, 2015 - PRLog -- The Newport Beach personal injury law firm of Bisnar Chase has filed a product liability lawsuit on behalf of plaintiff Nardin Andy, who alleges that he suffered severe facial injuries after an e-cigarette vaporizer exploded in his face and caused severe injuries. The lawsuit was filed on Sept. 22 in Los Angeles Superior Court (Case No. BC 595511) against the following defendants: Tobacco Revolution Smoke Shop, Shenzhen Longterm Technology Co. Ltd., Shenzhen Mxjo Technology Co. Ltd. and Alibaba Group Holding Ltd.

According to documents filed in court, on Jan. 27, 2014, the plaintiff in this case was using a Fogger 4 vaporizer with MXJO batteries and other component parts and fluids when the device exploded, burning him and sending shrapnel from the products into his mouth and face. He purchased the product from the Tobacco Revolution Smoke Shop in Whittier, the complaint states. Andy suffered serious burns and other injuries, the complaint states. The lawsuit seeks compensation for past and future hospital, medical and other healthcare expenses, lost wages, lost earning potential and other economic and non-economic damages.

"This was a horrible and unnecessary incident that resulted in severe injuries for our client," said Brian Chase, senior partner and trial lawyer at Bisnar Chase. "This incident has had a physical, emotional and financial effect on him."

Chase said it is the responsibility of all manufacturers including e-cigarette makers to ensure that their products are safe for consumers to use. "It is critical that these products are properly manufactured, designed, tested, assembled, packaged, labeled, advertised and sold," he said. "Manufacturers have a responsibility and legal obligation to implement quality control procedures and to adequately warn consumers about any potentially dangerous components, systems or contents that may make these products unsafe for normal use or any foreseeable misuses."

Chase said the existence of defective and dangerous electrical systems, batteries, chemicals and other components in the e-cigarette exposed the plaintiff to the "foreseeable effects of an explosion."

"The e-cigarette exploded and caused these serious injuries to our client because it was a defective product," he said. "Our client's injuries and damages were the direct result of the manufacturer's negligence and their move to put profits before the safety and well being of consumers."
