Spencer Lucas Details How to Win a “Mild” Brain Injury Case

In this month’s issue of Advocate, Panish | Shea | Ravipudi LLP’s own Spencer Lucas explains how to go about representing a client who has experienced a “mild” brain injury.  Although this type of injury can have lifelong repercussions, defense attorneys will take pains to discount the client as a malingerer, someone who plays up their so-called “mild” injury in order to gain a cash payout.  This couldn’t be further from the truth.  Mr. Lucas lays out step by step how a plaintiff’s attorney can counter these charges and win the case for their seriously injured client.  It starts with compiling medical records, including diagnostic imagery, and getting the client the intensive rehab he or she may need.  He also offers advice on demonstrating the impact of the injury, questioning experts for the defense, and setting the client up with a life-care plan.
